Understanding the legality of CBD can be tricky. Especially given its evolving legal history over the past few years. Let’s be clear – CBD is legal in the USA.
Before we dive into anything, we encourage you to check out the regulations of CBD posted by the FDA in October 2020. The FDA has several resources available that address cannabis and cannabis-derived products. These cover products like CBD and the agency wants to ensure that consumers have access to these resources in a centralized location.
IS CBD LEGAL?
Yes! CBD is a substance that is perfectly legal to purchase and consume. CBD is a cannabinoid that’s isolated and extracted from the cannabis plant. This cannabinoid has been one of the hottest natural lifestyle products to emerge in quite some time.
Modern research is now helping us to learn more about the endocannabinoid system in the human body. This system regulates various processes that keep the body in a state of homeostasis. The endocannabinoid system produces cannabinoids that interact with the nervous system. These cannabinoids are very complex, and we know they help to keep the immune system functioning properly. We also know they regulate everything from our internal temperature to our sleep patterns. This system is called the endocannabinoid system, and you can find more info on it here. It’s thought that these cannabinoids simply supplement the body with what it needs to stay balanced. If you’re interested in products that include CBD, you can visit our shop anytime!
THE DIFFERENCE BETWEEN MARIJUANA AND HEMP
Hemp-Derived CBD is legal to consume and purchase in the United States. This because it comes from the hemp plant rather than the marijuana plant. Both plants belong to the cannabis family. The difference between the two is that hemp, unlike cannabis, has no psychoactive properties when it is consumed. This is because of its incredibly low level of THC. THC is a cannabinoid that is responsible for the high that people experience when they consume it.
If you’re looking for supplemental information on the differences between cannabis and hemp, we’ve got you covered. Our friends at the Ministry of Hemp put out a very good article which explains this in detail.
Both marijuana and hemp come from the same base plant (cannabis). The primary distinction between the two is the strength of THC in the plant. Marijuana contains up to 30 percent THC, while hemp contains approximately 0.3 percent THC. Because of this, CBD products that come from the hemp plant rather than the marijuana plant don’t put users at risk of experiencing psychoactive effects. Therefore, CBD is not considered to be an illegal substance when consumed.
ARE MY PRODUCTS MADE FROM MARIJUANA OR HEMP?
Good question! What makes things a little confusing, is that in states in which marijuana is legal, it is also possible to purchase and consume CBD products that are derived from the marijuana plant. These products, however, cannot be transported into other states legally. So when consuming, it’s important to know where the CBD in the product comes from.
